THE SUN NEWS – A South Carolina woman is suing Chipotle Mexican Grill of Colorado LLC after food from a Myrtle Beach-area location allegedly made her “violently ill.”
Erica Quick became ill after consuming an order of beef brisket, brown rice and pinto beans from a Chipotle restaurant according to a personal injury lawsuit filed on her behalf on March 7 in the Common Pleas Fifteenth Judicial Circuit Court.
“Immediately upon eating it, Plaintiff became violently ill, went into sepsis shock and went to Waccamaw Hospital where she was treated,” the suit says.
Quick allegedly required intensive treatment for gastroenteritis from food poisoning.
According to the lawsuit, Chipotle was negligent, reckless and willful in one or more of the following ways:
- Selling food that was adulterated, contaminated, out-of-date and/or unsafe for human consumption
- Failing to ensure that food was in safe condition, kept properly refrigerated and/or kept according to health guidelines
- Failing to take reasonable skill and care, use food safety precautions, use food product safety standards and/or warn Quick that the food was dangerous
For actual and punitive damages, Quick is seeking a maximum of $74,499.99 …
